Data controller

Your personal data is processed by Şivekar as data controller under Turkish Personal Data Protection Law no. 6698 (“KVKK”), within the scope described below.

Personal data we process

Depending on your relationship with our restaurants and this website:

• Identity and contact data: the name and phone number you give when booking a table.
• Transaction security data: IP address, browser and device information and page records generated when you visit the site.
• Visual records: footage from the security cameras installed at our restaurants.
• Requests and complaints: the content of messages you send us by phone, WhatsApp or e-mail.

This website has no online booking, membership or payment form; reservations are taken by phone or WhatsApp only.

Purposes of processing

• Receiving reservation requests, holding tables and getting back to you.
• Providing restaurant services and ensuring guest satisfaction.
• Ensuring the security of our premises and guests (camera recordings).
• Operating and securing the website and measuring visit statistics.
• Handling requests and complaints and meeting our legal obligations.

Legal grounds

We rely on the grounds listed in article 5 of the KVKK:

• Processing directly related to the conclusion or performance of a contract (reservations and service delivery).
• Compliance with legal obligations (records required by tax legislation).
• Legitimate interests of the data controller, provided your fundamental rights are not harmed (premises and website security).
• Your explicit consent (analytics cookies and commercial electronic messages, if any).

How we collect data

Data is collected through phone calls, WhatsApp and e-mail correspondence, information given verbally at the restaurant, security cameras and cookies used on the website — by partly automated and non-automated means.

Transfers

Your data may be shared, only as far as the purposes above require, with the hosting providers of our website, the analytics provider we use to measure visits, our accounting and legal advisors and legally authorised public authorities.

If you accept analytics cookies, measurement data may be transferred to providers with servers abroad. If you do not consent, no such transfer takes place.

Retention

Your data is kept for as long as the purpose requires and for the statutory limitation periods set out in the applicable legislation. Camera recordings are automatically deleted or overwritten within a short period depending on system capacity. Once the period ends, data is deleted, destroyed or anonymised.

Your rights under article 11

By applying to the data controller you have the right to:

• Learn whether your personal data is processed,
• Request information if it has been processed,
• Learn the purpose of processing and whether the data is used accordingly,
• Know the third parties in Turkey or abroad to whom the data is transferred,
• Request correction of incomplete or inaccurate data,
• Request deletion or destruction under the conditions set out in the law,
• Request that such correction, deletion or destruction be notified to third parties,
• Object to a result against you produced solely by automated analysis,
• Claim compensation if you suffer damage due to unlawful processing.

How to apply

You can send your requests in writing to the e-mail address or the business address given in the details below, in line with the Communiqué on the Procedures and Principles of Application to the Data Controller. Please state your name, contact details and the subject of your request clearly.

Your request is answered free of charge as soon as possible and within thirty days at the latest. If the process requires an additional cost, the fee set by the Personal Data Protection Board may be charged.
